1. Acceptance of Terms
By accessing or using NPL Mobile Hospital's platform, website, mobile applications, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.
These Terms constitute a legally binding agreement between you and NPL Mobile Hospital ("we," "us," or "our"). We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Services constitutes acceptance of the modified Terms.
2. Eligibility
To use our Services, you must:
• Be at least 18 years of age, or have parental/guardian consent if between 13-17
• Have the legal capacity to enter into a binding agreement
• Not be barred from using the Services under applicable law
• Provide accurate and complete information during registration
• Maintain the security of your account credentials
Users under 13 years of age are not permitted to use our Services.
3. Description of Services
NPL Mobile Hospital provides a telemedicine platform that connects patients with licensed healthcare providers. Our Services include:
• AI-powered symptom assessment and triage
• Video, audio, and text-based consultations with doctors
• Electronic prescription services
• Digital health records management
• Appointment scheduling and reminders
• Health education resources
Our Services are designed to supplement, not replace, traditional in-person healthcare. We are not an emergency service, and you should call emergency services (911) for life-threatening conditions.
4. Medical Disclaimer
IMPORTANT MEDICAL DISCLAIMER:
• The information provided through our Services is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
• Our AI triage system provides preliminary guidance only and cannot diagnose medical conditions.
• Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition.
• Never disregard professional medical advice or delay seeking it because of information obtained through our Services.
• If you think you may have a medical emergency, call your doctor or emergency services immediately.
Healthcare providers on our platform are independent contractors, not employees of NPL Mobile Hospital.
5. User Accounts
When you create an account, you agree to:
• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Not share your account credentials with others
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.
6. Healthcare Providers
Healthcare providers on our platform:
• Are licensed medical professionals in their respective jurisdictions
• Undergo credential verification and background checks
• Maintain their own malpractice insurance
• Are independent contractors, not employees of NPL Mobile Hospital
• Make their own medical decisions and recommendations
We facilitate connections between patients and providers but do not practice medicine ourselves. The provider-patient relationship is between you and your healthcare provider.
7. Payments and Billing
By using our paid Services, you agree to:
• Pay all fees and charges associated with your account
• Provide valid payment information
• Authorize us to charge your payment method for fees owed
Fees and Payment Terms:
• Consultation fees are displayed before booking
• Payment is required at the time of booking or service
• Refunds are subject to our Refund Policy
• We may change our fees with 30 days' notice
Insurance:
• We may accept certain insurance plans
• Coverage verification is your responsibility
• You are responsible for any amounts not covered by insurance
8. Cancellation and Refund Policy
Appointment Cancellations:
• Cancel at least 24 hours before your appointment for a full refund
• Cancellations within 24 hours may incur a cancellation fee
• No-shows may be charged the full consultation fee
Refunds:
• Refunds are processed within 5-10 business days
• Refunds are issued to the original payment method
• We reserve the right to deny refunds for completed services
Technical Issues:
• If technical issues on our end prevent a consultation, you will receive a full refund or rescheduling option
9. Prohibited Uses
You agree NOT to:
• Use the Services for any illegal purpose
• Impersonate any person or entity
• Provide false information or misrepresent yourself
• Harass, abuse, or threaten healthcare providers or other users
• Attempt to obtain prescriptions for controlled substances fraudulently
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the Services
• Scrape, data mine, or collect user information
• Use the Services for commercial purposes without authorization
• Violate any applicable laws or regulations
Violation of these prohibitions may result in immediate account termination and potential legal action.
10. Intellectual Property
All content on our platform, including but not limited to:
• Text, graphics, logos, and images
• Software, code, and algorithms
• User interface design
• Audio and video content
is owned by NPL Mobile Hospital or our licensors and is protected by intellectual property laws. You may not:
• Copy, modify, or distribute our content without permission
• Use our trademarks without authorization
• Reverse engineer our software
• Remove any copyright or proprietary notices
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
• NPL Mobile Hospital is not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for Services in the 12 months preceding the claim
• We are not liable for the acts or omissions of healthcare providers
• We are not liable for technical failures, service interruptions, or data loss
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify, defend, and hold harmless NPL Mobile Hospital, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit or transmit through the Services
• Your negligent or wrongful conduct
13. Dispute Resolution
Any disputes arising from these Terms or your use of the Services shall be resolved as follows:
Informal Resolution: We encourage you to contact us first to resolve disputes informally.
Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules.
Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions.
Governing Law: These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
Jurisdiction: For disputes not subject to arbitration, you consent to the exclusive jurisdiction of courts in New York County, New York.
14. Termination
We may terminate or suspend your access to the Services:
• For violation of these Terms
• For fraudulent or abusive behavior
• For non-payment of fees
• At our discretion with or without cause
Upon termination:
• Your right to use the Services ceases immediately
• We may delete your account data (subject to legal retention requirements)
• Provisions that by their nature should survive will survive termination
You may terminate your account at any time by contacting us or using account settings.
15. General Provisions
Entire Agreement: These Terms constitute the entire agreement between you and NPL Mobile Hospital.
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
Assignment: You may not assign your rights under these Terms without our consent.
Force Majeure: We are not liable for failures caused by circumstances beyond our reasonable control.
